Defendants receive probation, deferred sentences

One man was given probation and two others received deferred adjudication on felony charges after hearings in 132nd District Judge Ernie B. Armstrong's courtroom recently.

Jose Alvarez Ferrusca, 49, of Snyder, was given a 10-year probated sentence after he entered a plea agreement to a third-degree felony charge of driving while intoxicated.

Ferrusca was also ordered to pay a $1,500 fine, $90 in restitution, $290 in court costs and $750 in reimbursement fees in connection with his conviction.

The charge stemmed from an October 2019 incident during which Ferrusca operated a motor vehicle in a public space while intoxicated. 

Ferrusca has two previous DWI convictions, in May 2004 in Mitchell County and December 2012 in Garza County.

Zachary Lyn Bast, 20, of Wellington was given five years probation, deferred adjudication, after he entered a plea agreement on a third-degree felony charge of claiming a lottery prize by fraud.

He was also ordered to pay a $1,500 fine, $290 in court costs and $660 in restitution.

On Nov. 21, 2019, Bast intentionally claimed a scratch-off ticket lottery prize of more than $200 but less than $10,000 by fraud.

Scott Herrera, 49, of Big Spring, was given three years probation, deferred adjudication, after entering a plea agreement on a state jail felony charge of possession of a controlled substance. 

He was also ordered to pay a $1,500 fine, $180 in restitution, $290 in court costs and $675 in reimbursement fees.

On June 22, 2019, Herrera was found in possession of less than a gram of methamphetamine.
