Entities challenging Kinder Morgan values

Four Scurry County taxing entities will challenge 2019 mineral values during an Appraisal Review Board hearing Friday morning.
Attorney Brent Lemon filed the petition for Scurry County, Snyder ISD, Western Texas College and the Scurry County Hospital District on May 30. Chief Appraiser Jackie Martin set the date for all parties, including representatives from Thomas Y. Pickett and Company, to attend the ARB hearing.
In filing his petitions, Lemon wrote that each entity “asserts that for years 2019, and 2012-18, Cat. G mineral interest real property owned by Kinder Morgan in Scurry County was erroneously and incorrectly excluded and omitted from appraisal, including due to taxpayer misrepresentation and fraud.”
Lemon’s petition stated that the entities are seeking “all relief available for the exclusions/omissions, including the ‘fixing’ of the values and back-appraisal.”
The ARB heard a similar request in 2018 from Lemon, but denied his request for a reappraisal of mineral values in the county. 
The entities took that ARB ruling to district court and Kinder Morgan has filed an appeal over Judge Ernie B. Armstrong’s ruling that the company’s motion to appeal was not filed in a timely manner. The appeal process is underway in the 11th Court of Appeals in Eastland with no hearing date scheduled at this time.
The ARB hearing is scheduled to begin at 9 a.m. in the appraisal district office and is open to the public.
The ARB will hold a second session beginning at 11 a.m. Friday during which Kinder Morgan plans to appeal its 2019 values. That hearing may be closed to the public “to consider proprietary or confidential information.”
A closed session to discuss litigation with the ARB attorney is listed on the agenda. Any action from that closed session will be held in open session.
The 11 a.m. session does include a time for the public to make comments or ask questions of the ARB, the agenda stated.
The ARB is also scheduled to conduct a second round of taxpayer protest hearings at 1 p.m. Friday.
