Ford Motor Credit drops dealerships from lawsuit

Reagor-Dykes Snyder location was one of ‘Reagor Entities’ listed in suit

Dealerships in the Reagor-Dykes Auto Group are no longer part of a lawsuit filed by Ford Motor Credit Company.
On Thursday, U.S. District Judge Sam Cummings granted Ford Motor Company’s motion to dismiss the lawsuit listed as “Reagor Entities,” stating the dealerships and companies are now open to civil action from outside claims. 
He also said all previous claims specifically tied to the “Reagor Entities” that were part of the Ford Motor Credit lawsuit would move into a separate case.
The Snyder dealership was not listed as a “Reagor Entity” in the original lawsuit, but was later added to the list.
However, the Ford Motor Credit lawsuit against Bart Reagor and Rick Dykes is still proceeding, Lubbock media reported Thursday.
According to the Ford motion, since the group went into bankruptcy protection on Nov. 2, Ford’s claims against the group are subject to an automatic stay provisions of the federal bankruptcy code. 
But, according to Ford, the stay does not apply to Reagor or Dykes since neither man has filed for personal bankruptcy.
In early November, the Snyder dealership filed for bankruptcy, but not before being hit with a tax lien and lawsuit. The comptroller’s office filed a state tax lien against Reagor-Dykes Snyder, LP, for more than $3,000.
In late October, a Georgia-based bank filed a lawsuit against Reagor-Dykes Snyder, claiming a trade-in check was returned due to insufficient funds.
The dealership also failed to pay some Snyder businesses and Scurry County for various expenses it incurred.
