SCAD board to discuss lawsuit in closed session

The Scurry County Appraisal District board of directors, on Thursday, will receive an update on a lawsuit filed by four county taxing entities.
A closed session to receive an update on the 2018 lawsuit from the board’s attorney is on the agenda. Any action resulting from that discussion will be taken in open session.
Last month, the 11th Court of Appeals heard arguments from Kinder Morgan attorneys that its motion to dismiss the case was filed in a timely manner. District Judge Ernie B. Armstrong ruled it was not filed in the required timeline of the original lawsuit filed by attorney Brent Lemon on behalf of Scurry County, Snyder ISD, Western Texas College and the Scurry County Hospital District.
The appellate court has not ruled on Kinder Morgan’s appeal.
“Kinder Morgan always aims to resolve tax valuation matters amicably, without bringing the matter before a court,” a spokesperson for Kinder Morgan said following last month’s appeal hearing. “Unfortunately, the company was unable to reach an agreement in this instance. When an appraisal district proposes to nearly double our tax liability, we are compelled to appeal.”
Lemon declined to comment on the appeal following the hearing.
Chief Appraiser Jackie Martin is also scheduled to give board members an update on district activities.
The meeting is scheduled to begin at 8:30 a.m. and is open to the public. A time has been set aside for the public to comment on appraisal district activities.
