A theft charge against a Snyder man was dropped, and a man and woman are headed to prison after their probations were revoked recently in District Judge Ernie B. Armstrong’s courtroom.
Reyes Silva Gonzales, 36, had his state-jail felony theft charge dismissed after he made full restitution to his victim. He was indicted on the charge in September 2012.
Alvin Napoleon Smith, 23, of Dallas, was originally given a five-year probated sentence in June 2012 for burglary of a habitation, a second-degree felony.
At that time, he was ordered to pay a $1,500 fine, $348 in court costs and to participate in the TAIP program.
His probation was revoked after Smith was convicted of theft in December in Tarrant County, was arrested on at least three occasions and did not notify his probation officer, in Dallas County, Tarrant County and Ellis County, and failed to report to his probation officer, make his monthly court, restitution, probation and fine payments multiple times between July 2015 and September 2016.
Carmen Viera, 32, of El Paso, had her probation revoked after multiple convictions in El Paso County between November 2014 and July 2015. She also failed to to report to her probation officer and make monthly court, restitution, probation and fine payments multiple times between October 2014 and August 2016. She also missed a probation performance review in December 2104 and failed to complete community service between October 2014 and August 2016.
She was originally convicted of driving while intoxicated, a third-degree felony, in September 2014.
At that time, she was given a five-year probated sentence and ordered to pay a $1,500 fine, $610 in court and attorney fees and to participate in the TAIP program.
